Renewable Power Transaction.

(a) This is an agreement between Community Green Energy, LLC (CGE) and the Buyer to purchase Renewable Energy Certificates (RECs), also known as Renewable Energy Credits or Green Tags, in blocks equal to that determined as typical for one month, three months or one year for one of the following:

An idividaul child, student or adult.

An apartment or small, medium or large house.

A small, medium or large business.

CGE has estimated these amounts based on figures released by the Department of Energy and our own calculations. Subject to the terms of this Agreement, Community Green Energy, LLC (CGE) agrees to sell, and Buyer agrees to purchase and pay for, Renewable Energy Credits (RECs) from the resource(s) and at the quantity and purchase price indicated. A surcharge to cover the renewable energy purchase may be charged by CGE (see Billing and Payment section below). This product represents a voluntary purchase and is in no way related to your purchase of electricity, and all costs associated with your purchase are in addition to your standard rates for electricity supply and delivery services.

(b) Each REC represents the environmental attributes resulting from the generation of 1 MWh (1,000 kWh) of electricity by renewable energy generators serving power systems in the United States (the Applicable Power Systems). Your product represents the environmental attributes resulting from the generation of a block equal to the amount of electricity listed in the product description, and may comprise a portion of or a multiple of a REC. These environmental attributes include all fuel source, emissions, air quality and other environmental characteristics and benefits resulting from the generation of energy by the applicable renewable energy resource, excluding any state or federal production tax credits, production tax incentives or production tax grants generated or earned by the renewable resource facility owner. Environmental attributes may be used to reduce the pollution impact of an equivalent amount of electricity generated from the sources used to generate typical system power. CGE represents and warrants that it is selling the RECs once and only once to Buyer, and that Buyer shall be entitled to claim or take credit for the environmental attributes related to the RECs. The Buyer shall not be able to re-sell the RECs, or make claim to the proceeds from a resale of the RECs, should the purchased RECs not be consumed.

(c) Buyers purchase of RECs under this Agreement ensures that an amount of energy equal to the number of RECs purchased under this Agreement times 1 MWh is generated from the type of renewable resource(s) indicated above and delivered to the Applicable Power Systems over the course of one year. To verify this delivery, CGE will retire renewable energy certificates on behalf of Buyer. Consistent with Green-e® Energy certification standards, these renewable energy certificates wherever possible will be generated in the calendar year of the Effective Date, not later than the first three months of the following calendar year.

Pricing

Pricing of CGE RECs is based on the timeframe of the block purchased, and is the same whether the REC package is for an individual, residence or business.

  • RECs purchased in one-month blocks are priced at $27.50 per REC (1 REC = 1 MWh, or 1,000 kWh, of electric use)
  • RECs purchased in three-month blocks are priced at $25.00 per REC (1 REC = 1 MWh, or 1,000 kWh, of electric use)
  • RECs purchased in calendar year blocks are priced at $20.00 per REC (1 REC = 1 MWh, or 1,000 kWh, of electric use)

A charge of $1.50 is also assessed if you elect to receive a printed certificate, to offset the cost of production and mailing. You may avoid this charge by electing to receive no certificate, in which case you will will receive a PDF version via e-mail, rather than a printed version via post.

If you decide that you would like a printed certificate for a REC package purchased without one, you may purchase it as a separate item using our e-commerce site. There is an item listed for such a purchase. You must make your purchase before the REC package expires, and you must provide the serial number of your initial purchase.

You must pay all applicable federal, state, and local taxes and charges.Prices are subject to change. CGE will provide at least 30 days notice of any changes in these terms and conditions by mail or email.

Billing and Payment

The Buyer agrees to pay the renewable energy charge for the RECs purchased, based on the term agreed to on the website. These charges are in addition to the Buyers standard supplier electricity delivery and supply charges for all of Buyers monthly electricity usage.

CGE only sells Green-e Energy certified RECs. Green-e is the nation’s leading independent renewable energy certification and verification program. In addition, CGE makes the following commitments:

The RECs you purchase will be generated in the calendar year of your purchase, the first three months of the following calendar year, or the last 6 months of the prior calendar year.
  • CGE agrees to obtain and maintain information necessary to substantiate our purchase and retirement of RECs on your behalf. This includes the description of the source of our RECs, the number of RECs produced and retired, and the calendar year in which the RECs were produced. We will communicate this information to you no less than once per year.

Buyer must obtain advance approval of any use of the CGE logo or other trademarks in any press release or other promotional material that describes this transaction.

Not a Purchase of Electricity. This transaction is not a purchase of electricity and CGE is not an electricity provider in competition with Buyer’s current electric utility.

Limitations of Liability; Disclaimer Of Warranties. NEITHER PARTY WILL BE LIABLE TO THE OTHER FOR SPECIAL, CONSEQUENTIAL, INCIDENTAL, EXEMPLARY OR PUNITIVE DAMAGES FOR A BREACH OF THIS AGREEMENT, REGARDLESS OF WHETHER THOSE DAMAGES ARE CLAIMED UNDER CONTRACT, WARRANTY, INDEMNITY, TORT OR ANY OTHER THEORY AT LAW OR IN EQUITY. NOTWITHSTANDING ANY PROVISION HEREIN, CGE’S LIABILITY UNDER THIS AGREEMENT SHALL BE LIMITED TO THE TOTAL PURCHASE PRICE PAID TO CGE BY BUYER. Unless specifically set forth herein, neither Party makes any representation or warranty whatsoever, express or implied, to the other Party and hereby disclaims any such purported representation or warranty, Including any IMPLIED Warranty of MERCHANTIBILITY OR FITNESS FOR A PARTICULAR PURPOSE.
